Consent to Electronic Communications

When you submit a request, you agree to receive records and messages electronically. This page explains what that means and how to change your mind.

  • E-SIGN Act consent
  • Calls and texts explained
  • Reply STOP to opt out
Quick answer

By submitting a loan request on VivaLoanApp, you agree under the E-SIGN Act to receive disclosures and records electronically, and you consent to calls and texts about your request as described under the TCPA. Consent to marketing calls or texts is not a condition of any loan. Reply STOP to texts or email [email protected] to withdraw.

Overview and scope

Last updated: November 2, 2026.

The Electronic Signatures in Global and National Commerce Act (E-SIGN Act) lets businesses provide records electronically if you agree first. This consent covers communications between you and VivaLoanApp. It also covers your agreement that lenders and lending partners who receive your request may contact you electronically about it.

Electronic communications include:

  • This consent, our Terms of Use and Privacy Policy
  • Confirmations and status updates about your request
  • Notices, disclosures and other records we are required to give you
  • Messages sent by email, text, website notice or in-form display

Your consent applies to the request you submit and to any later messages about it. It stays in effect until you withdraw it as described below. You can give or refuse it freely; we explain below what refusing means for your request.

Each lender will ask for its own e-consent before sending loan documents. Your loan agreement and TILA disclosures come from the lender, not from VivaLoanApp.

Hardware and software requirements

To receive and keep electronic records, you need:

  • A computer, tablet or smartphone with internet access
  • A current version of Chrome, Safari, Firefox or Edge with cookies and JavaScript enabled
  • A valid email address you check regularly
  • Software that opens PDF files, if a record is provided as a PDF
  • Enough storage to save records, or a printer to print them

By submitting the request form, you confirm that you can access and keep electronic records in these formats. If our requirements change in a way that could stop you from accessing records, we will tell you and give you the chance to withdraw consent without a fee.

Withdrawing consent, paper copies and updates

How to withdraw consent

Email [email protected] with the subject line “Withdraw E-Consent.” Include your name and the email address you used. Withdrawal takes effect after we have had a reasonable time to process it and does not affect records already delivered. Because the service is online only, withdrawing may mean we cannot process a new request.

Paper copies

You can ask for a paper copy of any record we provided electronically by emailing us. There is no fee. Print or save records when you receive them, since we may not keep them on the site indefinitely.

Updating your contact information

If your email address or phone number changes, email us with the old and new details so messages reach you. For an open loan, update your details with the lender directly.

The Telephone Consumer Protection Act (TCPA) limits automated calls, prerecorded messages and texts to mobile numbers without consent. When you submit a request and give a phone number, you agree that VivaLoanApp, its service providers, and lenders and lending partners who receive your request may call or text you at that number about your request. These calls or texts may use automated technology or prerecorded messages.

Your consent to receive marketing calls or texts is not a condition of submitting a request or getting a loan.

  • Message frequency varies with your request and lender activity.
  • Message and data rates may apply, based on your mobile plan.
  • Only give a number you own or are authorized to use.

Reassigned or changed numbers

If you give up a phone number you used on our form, please tell us so messages do not reach the next person who gets it. Email [email protected] with “Number Change” in the subject line. If you received a message meant for someone else, reply STOP and we will remove the number.

Other phone laws

Some states add their own limits on calling hours and text frequency. Lenders and partners must follow those rules, and the National Do Not Call Registry still applies to marketing calls you have not consented to. You can register your number at donotcall.gov.

How to opt out of calls and texts

  1. Texts: reply STOP to any text message. You will receive one confirmation and then no further texts from that sender. Reply HELP for help.
  2. Calls: tell the caller you no longer want calls, and they must record your request.
  3. Email us: send “Stop Calls and Texts” as the subject line to [email protected], with your phone number.

Opting out with VivaLoanApp does not stop lenders that already have your information. Contact each lender to opt out of its messages. You may still receive required messages about an active loan. To learn how lenders use your data, see Disclosures. Ready to start? Submit your free request.
